How To Update Your Marital Status with the BIR

From Cinemagra.ph. Changing one's marital status from single to married
or any changes in one's status.

The BIR Form 2305 is what you will need to update your status with the BIR. Just click BIR Form 2305 to view a online copy of this form.

You can have it printed so you can fill out the said form. In Part V for this form entitled "EMPLOYER INFORMATION". This portion should be filled up by your EMPLOYER not you. This is required for those with EMPLOYERs.

The required documentary attachment for this application is your MARRIAGE CERTIFICATE.

If a Taxpayer has no EMPLOYER or has a business. The BIR Form 1905 should be used to UPDATE his or her status. In Part II of this form check letter "K" and in the provide blank box write "UPDATE STATUS & REGISTERED NAME TO MARRIED NAME".  The second page or back side of this form in "4G" check REGISTERED NAME. And in the provided boxes in "NEW" write your MARRIED NAME and in OLD your MAIDEN NAME. Attached marriage certificate.

TAKE NOTE: You should submit this application form to the BIR branch office or Revenue District Office where your TIN is currently registered.

If you are unsure which Revenue District Office (RDO) or BIR branch office your TIN is currently registered then call 981-8888 the BIR Contact Center.

  1. Hi tomtax! I just want to ask, what if I am going to change my civil status and at the same time it is a required by our employer, will I need to file 2 different form 2305's or I can combine the change of civil status and update of employment in one filing? thank you!

      sorry for the late reply. Yes, you can actually indicate both.

      Since that form includes employer information.

      Just make sure that your TIN is registered with the SAME BIR branch as your current employer.

    1. Single, Head of the Family and Married individual have the same personal exemptions which is 50K.

      Additional Qualified Dependent Child 25K max of 4.

      Declared dependents are qualified first.

  3. Under the new scheme signed by then Pres. Arroyo.

    Single, Head of the Family or Married are all given the SAME personal exemptions of 50K.

    So there is no reason really to update UNLESS your married.

  5. hi i really need some help.. i have not update my status with my current employer and i just resigned and about to start my new job with a different company,i told my new employer that i am married and i need to update my status they said that they need the marriage certificate. i really dont know what to do if what name will i put on all of the requirements do i have to change my name already and use my husbands name or its ok for me to still use the name i have before getting married?? please respond..

      anyway, if your married then you need to update this with your employer and with the BIR. As this is now your current status and name.

      So yes, you need to change your name to the status you are now in.

    1. Upon submission of the required docs to the correct BIR REvenue District Office (RDO)

      If you submitted the said form 2305 to the wrong RDO. The said RDO cannot process your application.

      Verify first where your TIN is currently under? or which RDO is it under.

      Your RDO should be the same with your currently employer. If not request for transfer using 1905, which you need to submit to the current RDO where your TIN is currently under.

      Once transferred which would take 3-4 days. So call 981-8888 if your RDO is now with the RDO of your employer.

      Once thats done. Thats when you go to that RDO and submit your 2305 attached your marriage cert. have it stamped

      Give a copy to your employer as that is what they will follow. The status you declared with the BIR.

    1. Maari po ninyo ipatransfer muna ang inyong TIN mula sa province papunta sa RDO kung san RDO naka register naman yun pinagtratrabahuhan mo. Puwede pong ipa fax ang 1905 request for transfer ninyo. Once na na transfer po sa sa bagong RDO ninyo. Pasa kayo ng 2305 form attached po yun birh cert. ng inyong anak.

    2. Your employer may be penalized for that. And I don't think they will do that unless you submit the 2305 duly stamped by the RDO. They will likely require you to submit also 1905 to prove that you transferred your TIN to the RDO where your employer is currently registered with.

      This is why most employers require this 2 forms to be submitted to them.

    1. Yes, if you are married to him you can claim, but you need to update your status with the BIR thru 2305 form attache your marriage cert. Then your husband execute a waiver duly notarize in your behalf waiving his rights to the additional exemptions. You can no longer claim additional exemption for children over 21.

  11. hi good day..i got marreid last april 19,2011 and i change my status in BIR as a married with 1 dependent then the BIR send me a new TIN ID with my marreid name but in different TIN# so it means a had a two different TIN# but i still using the old one,last june 17 2014 i visit one of the RDO office to checked my status i am wondering thet im still single with-out depentdent..what im going to do with the other TIN# and my status, i pay for almost 2 1/2 years but im still single in BIR,thankyou

    1. You need to file an update on your status with your RDO. you cannot file it in any BIR BRANCH or RDO. You need to file your 2305 form for update with your RDO where your TIN is currently registered. The BIR does not send TIN ID. Taxpayers are required to pick them up with their RDO. i do not know any RDO that provides that type of service yet. If you have TWO TINs you need to decide which you are going to use. We are only allowed ONE TIN.

      Any declaration like separation will need documents like what you said.

  15. my husband ad i just have our first baby last december. his BIR stat is single. we wanted to change his stat to M1 however NSO birthcertificate can be available from NSO office after 3months. can we submit Municipal certified true copy of birthcertificate to BIR? or is it strictly NSO issued birthcertificate only?

  21. Hello! I got married this year lang (month of May) pero UNEMPLOYED ako ngayon.. Gusto ko lang sana i-update yung MARITAL STATUS ko sa BIR para magkaron ako ng updated TIN ID with my MARRIED SURNAME on it. Ok lang kaya na i-update yun kahit hindi na ako active member? Isa pa NEVER pa ako nagkaroon ng TIN ID simula ng first work ko before pa pero may TIN # naman ako.

    1. your status I believe remains single with the BIR. Just declare your children your dependents using the form 2305. Check with the RDO or REvenue District Office of BIR if your status is indeed married. But again how can that be if your saying you never married.

      So I believe your still single based on your story.

    1. its not retroactive. but it will be applied the whole of 2015 provided you updated your status on or before the 10th of the following year. anyway, I'll make a post on this to clarify on this concern more.

    1. That means your TIN is registered with BIR Novaliches so the BIR in Lipa cannot do anything or process anything under your TIN.

      You need to transfer it first to BIR LIPA. If your employer is under that BIR office.

      If your going to be self-employed or going into business. The form to use would be 1901 form.

      Your business address would determine which RDO your TIN should be under.

      So if your TIN is not in the RDO where your business address is located. YOu need to transfer your TIN. To the RDO which handles the area where your business address is located.

    1. check which BIR RDO your TIN is currently under first. CAll 981-8888 or 981-7000 local 7250 up to 7252.

      Once your know which RDO your TIN is currently under. Thats where you need to go to pass your 2305 for update. Have it stamped. And provide your employer with a copy of this. Have it receive by your employer as proof that you gave them this update form you passed to BIR.

      You can request for TIN card using BIR form 1905. under others there is a box there write TIN CARD. At the back print name and sign and pass to the client support section of the RDO.

I just got married, unemployed and about to change my name, is form 1905 enough to update my name and my marital status? If not please include the answer on your reply.
